Terms and Conditions

1. Acceptance of Terms

By accessing or using the ACS Calibration website or services, you agree to be bound by these Terms and Conditions, per ISO/IEC 17025:2017, Clause 7.1.1. If you disagree with any part, you must not use our services.


2. Contract Review

ACS Calibration conducts a thorough review of all requests and contracts to ensure capability and resources meet your needs (ISO/IEC 17025:2017, Clause 7.1.2). Any deviations or clarifications will be communicated prior to acceptance.


3. Calibration Services and Quotes

Quotes are valid for 60 days from issuance and may change based on new information or circumstances. Turnaround time is 5-7 business days, subject to availability and ISO/IEC 17025:2017, Clause 7.1.3 compliance.

For items used in further calibrations, certificates must include measurement uncertainty per ILAC P14:01/2013 and ISO/IEC 17025:2017, Clause 7.2.1.2. Indicate this in special instructions.

Decision rules for accredited calibrations (Clause 7.2.2) use simple acceptance (w=0, AL=TL) unless legally required otherwise, with a 50% risk of false accept/reject. Guard-banding (e.g., w=U, AL=TL-w) is available upon request.


4. Scheduling and Payment

Purchase Orders (PO): Net 30 days from invoice date. Non-PO/New Customers: Payment in full upon service completion before report release.


5. Shipping and Damage

Shipments to ACS Calibration are FOB Origin, at the client’s risk. We are not liable for transit loss or damage; reimbursement is limited to fees charged for affected services.


6. Cancellation and Billing

Clients canceling scheduled onsite instruments that cause the total invoice to fall below $850 are subject to a minimum fee of $850, plus outstanding travel costs if outside a 200-mile radius.


7. Quality Feedback

Per ISO/IEC 17025:2017, Clause 8.6.1, we monitor performance through your feedback. Per Clause 8.6.2, we use it to improve. Contact us at quality@acscalibration.com, 334.792.0113, or Client Feedback page with concerns or suggestions.


8. Limitation of Liability

For onsite services, liability is determined in agreement with the client. ACS Calibration carries liability insurance tailored to client requirements and is not liable for indirect, incidental, or consequential damages from website or service use, to the fullest extent permitted by law.


9. Intellectual Property

All website content (text, graphics, logos) is ACS Calibration’s property, protected by copyright. Reproduction or distribution without permission is prohibited.


10. Governing Law

These Terms are governed by Alabama law, U.S., excluding conflict of law provisions.


Privacy Policy

11. Data Collection

We collect personal data (name, email, phone) for quotes, feedback, and services, and technical data (IP, browser) to enhance our site, ensuring compliance with applicable laws.


12. Use of Data

Data is used to process requests, deliver services, communicate, and improve offerings. It may be shared with secure third-party providers (e.g., payment processors).


13. Data Protection

Your data is encrypted and access-controlled per industry standards. We comply with GDPR for EU residents and retain data only as needed.


14. User Rights

Access, correct, or delete your data by contacting quality@acscalibration.com. Identity verification may be required.


15. Cookies

Cookies enhance experience and analyze usage. Disable them in your browser, though functionality may be affected.


NDA

16. Confidentiality Obligations

You agree to keep confidential all data (e.g., reports, methods) shared during services, disclosing only with written consent unless legally required.


17. Scope of Confidential Information

Includes all service-related data, excluding publicly available or third-party-sourced information without restriction.


18. Duration

This NDA lasts 5 years from your last interaction or indefinitely if required by law.


19. Exclusions

Confidentiality excludes independently developed or lawfully obtained data without breach.


20. Remedies

Unauthorized disclosure may lead to injunctions and damages. Notify us immediately at quality@acscalibration.com if a breach occurs.
